Persecução Criminal Constitucional

The aim of the present work is to study criminal prosecution, the application of the constitutional principles of the democratic rule of law and their consequences. In order to accomplish this goal we started by researching the origins and the formation of the State, from Ancient Greece through to the early the 21st century. We then looked, in the origins of constitutional criminal law and criminal procedural law, for the legal relationship between these branches of law and the democratic form of government. In a democratic rule of law, the procedural instrumentality of the application of substantive law follows several principles, amongst which we would highlight human dignity and legal defense as the pillars of Law and Justice.

L’objectif de ce travail est d’étudier la persécution criminelle, l’application des principes constitutionnels de l’État démocratique de droit et ses conséquences. Pour y arriver, nous avons commencé par des recherches sur l’origine et la formation de l’État, depuis la Grèce antique jusqu’à l’aube du XXIe siècle. Ensuite, nous avons cherché, à l’origine du Droit constitutionnel et de Procédure pénale, les relations juridiques entre ces branches du droit et la forme démocratique de gouvernement. Dans l’État démocratique de droit, l’instrumentalité procédurale de l’application du droit matériel suit plusieurs principes, parmi lesquels doivent être soulignés la dignité humaine et la large défense en tant que piliers de la Loi et de la Justice.
